Following the death of a child during an activity session in September 2021 the provider has been found guilty of breaches of The Health and Safety at Work (etc) act 1974.

The fatal incident and prosecution highlight the importance of providers ensuring they have:
- adequately assessed and controlled the risks associated with the activities they provide, in the locations at which they operate
- deployed instructors who have and understand safe systems of work, relevant information, instructions, training, and supervision
